THE SECURITY ADMINISTRATIONPUNISHMENT ACT OF THEPEOPLE'S REPUBLIV OF CHINA（ Digest ）
第一章 总 则
Chapter I
General Provisions
第一条 为加强治安管理，维护社会秩序和公共安全，保护公民的合法权益，保障社会主义现代化建设的顺利进行，制定本条例。
Article 1 This Act has been formulated in order to reinforce the Security Administration, safeguard social order and public security, protect the lawful rights and interests of citizens and guarantee the smooth progress of the construction of socialist modernization.
第二条 扰乱社会秩序，妨害公共安全，侵犯公民人身权利，侵犯公私财产，依照（中华人民共和国刑法）的规定构成犯罪的，依法追究刑事责任；尚不够刑事处罚，应当给予治安管理处罚的，依照本条例处罚。
Article 2 Any person whose action of disturbing social order， disrupting public security ， infringing upon citizens' individual rights or violating public or private property is serious enough to be deemed criminal according to the Criminal Law of the People's Republic of China shall bear criminal responsibility according to law; any person whose action is not enough for criminal punishment will be punished by the Security Administration according to this Act ．
第三条 在中华人民共和国领域内发生的违反治安管理行为，除法律有特别规定的以外，适用本条例。
Article 3 This Act is applicable to all who violate the Security Administration within the territory Of the People's Republic Of China except as specially stipulated by law．
第四条 在中华人民共和国船舶或者航空器内发生的违反治安管理行为，也适用本条例。
Article 4This Act is also applicable to all who violate the Security Adm-inistration aboard a ship or aviation vehicle Of the People′s Repu-blic of China ．
第五条 对于因民间纠纷引起的打架斗殴或者损毁他人财物等违反治安管理行为，情节轻微的，公安机关可以调解处理。
Articles 5 Public security organs may use mediation to settle fights, damages of property caused in civil conflicts and other acts violating the Security Administration when the circumstance is minor.
第二章 处罚的种类运用
Chapter II
Types and Application off Punishments
第六条 对违反治安管理行为的处罚分为下列三种：
Article 6 There are three types punishments for violating the Se-curity Administration:
（一）警告。
l） Warning
（二）罚款：一元以上，二百元以下。本条例第三十条、第三十一条、第三十二条另有规定的，依照规定。
2） Fines ： From one Yuan up to not more than two hundred Yuan. Separate stipulations made in Article 30,31,and 32 in this Act shall be implemented accordingly.
（三）拘留：一日以上，十五日以下。
3） Detention ： From one day up to not more than fifteen days ．
第十二条 醉酒的人违反治安管理的，应予处罚。
Article 12 An intoxicated person who violates the Security admi-nistration shall be punished．
第十六条 违反治安管理有下列情形之一的，可以从轻或者免予处罚；
Article 16 Offences against the Security Administration committed under any one of the following circumstances can be given a lesser punishment or exempted from punishment：
（一）情节特别轻微的；
l） Violations are minor ；
（二）主动承认错误及时改正的；
2） The offender takes the initiative to admit his mistakes and promptly correct it;
（三）由于他人胁迫或者诱骗的。
3） The offender was coerced or induced by another person ．
第十七条 违反治安管理有下列情况之一的，可以从重处罚：
Article 16O Offences against the Security Administration committed under any one of the following circumstances can be given a heavier punishment:
（一）有较严重后果的；
l） The violation has serious consequences ；
（二）胁迫、诱骗他人或者教唆不满十八岁的人违反治安管理的；
2） One who coerces or induces another person, or instigates a person under the age of eighteen to violate the Security Administration;
（三）对检举人、证人打击报复的；
3） One who retaliates against an accuser or witness;
（四）屡犯不改的。
4） One who refuses to mend his ways despite repeated admonition.
第三章 违反治安管理行为和处罚
Chapter
Acts Against the Security administration
and Punishments for Violating
the Administration
第十九条 有下列扰乱公共秩序行为之一，尚不够刑事处罚的，处十五日以下拘留、二百元以下罚款或者警告；
Article 19 Any person who commits one of the following acts of disturbing the public order when not serious enough for criminal punishment is subject to detention of not more than fifteen days, to a fine of not more than two hundred Yuan, or to a warning:
（一）扰乱机关、团体、企业、事业单位的秩序，致使工作、生产、营业、医疗、教学、科研不能正常进行，尚未造成严重损失的；
l） Disturbing the order and ， as a consequence ， disrupting the normal function of work, production ， business operation ， medical practice ， teaching and scientific research in government organs ， people's organizations, enterprises and institutions but not causing serious damage;
（二）扰乱车站、码头、民用航空站、市场、商场、公园、影剧院、娱乐场、运动场、展览馆或者其他公共场所的秩序的；
2） Disturbing the order at stations ， wharves ， civil aviation stations ， market places ， public parks ， theaters ， recreation spots ， sports grounds ， exhibitions or other public places ；
（四）结伙斗殴，寻衅滋事，侮辱妇女或者进行其他流氓活动的；
4） Assembling a crowd for a brawl ， stirring up fights ， causing trouble ， humiliating women or engaging oneself in other hooligan activities ；
（七）拒绝、阻碍国家工作人员依法执行职务，未使用暴力、威胁方法的。
7） Refusing or impending government personnel in carrying out their duties according to law without the use if violence or coercion.
第二十条 有下列妨害公共安全行为之一的，处十五日以下拘留、二百元以下罚款或者警告：
Article 20 Any person who commits one of the following acts of disruption public security is subject to detention of not more than fifteen days, a fine of not more than two hundred Yuan, or a warning
（三）非法制造、贩卖、携带匕首、三校刀、弹簧刀或者其他管制刀具的；
3） Illegally manufacturing ， selling or carrying daggers ， triangular scrapers ， spring knives or other kinds of knives under control ；
（五）组织群众集会或者文化、娱乐、体育、展览、展销等群众性活动，不采取相应的安全措施，经公安机关通知不加改正的；
5） Organizing public gatherings or other public activities Of
culture， recreation ， sports ， exhibition or a sale-exhibit fair without taking adequate safely measures and refusing to the violation
when notified by a public security organ.
第二十二条 有下列侵犯他人人身权利行为之一，尚不够刑事处罚的，处十五日以下拘留、二百元以下罚款或者警告：
Article 22 Any person who commits one of the following acts infringing upon the rights of another person, when not serious enough for criminal punishment, is subject to detention of not more than fifteen days, a fine of not more than two hundred Yuan or a warning：
（一）殴打他人，造成轻微伤害的；
l） Beating another person and causing slight injury ；
（二）非法限制他人人身自由或者非法侵入他人住宅的；
2） Illegally restricting the freedom of another person or intruding into the house of another person.
第二十三条 有下列侵犯公私财物行为之一，尚不够刑事处罚的，处十五日以下拘留或者警告，可以单处或者并处二百元以下罚款：
Article 23 Any person who commits one of the following acts
violating public or private property, when not serious enough for criminal punishment, is subject to detention of not more than fifteen days, a warning, or a fine of not more than two hundred Yuan as an additional or exclusive punishment.
（一）偷窃、骗取、抢夺少量公私财物的；
1） TO steal ， swindle or forcibly seize a small amount of articles of public or private property;
（二）敲诈勒索公私财物的；
3） To extort pubic or private property by blackmail;
（三）故意损坏公私财物的。
4） TO intentionally damage property by blackmail;
第二十四条 有下列妨害社会管理秩序行为之一的，处十五日以下拘留、二百元以下罚款或者警告：
Article24 Any person who commits one of following acts disrupting the order Of the Social Administrator, is subject to detention of not more than fifteen days, a fine of not more than two hundred Yuan or a warning;
（三）违反政府禁令、吸食鸦片、注射吗啡等毒品的；
3） To smoke opium ， inject morphine or use other narcotics in violation of government control;
第二十五条 妨害社会管理秩序，有下列第一项至第三项行为之一的，处二百元以下罚款或者警告；有第四项至第七项行为之一的，处五十元以下罚款或者警告；
Article25 Any person who commits any one of the following acts, as listed from item 1 to 3, for disrupting the order of the Social Administration is subject to a fine of not more than two hundred Yuan or a warning; and person who commits any one of the following acts, as listed from item 4 to item 7, is subject to a fine of not more than fifty Yuan or a warning；
（五）故意损毁路灯、邮筒、公用电话或者其他公用设施，尚不够刑事处罚的；
5） To intentionally damage streetlights, mail boxes, public telephones or other public facilities, when not serious enough for criminal punishment;
（六）违反规定，破坏草坪、花卉、树木的；
6） To damage lawns ， flowers and trees against regulations;
第二十六条 违反消防管理，有下列第一项至第四项行为之一的，处十日以下拘留、一百元以下罚款或者警告：
Article26 Any person who commits any one of the following acts， as listed from item l to item 4 for violating the Fire Control Administration is subject to detention of not more than ten days ， a fine of not more than one hundred Yuan or a warning ；
（四）过失引起火灾，尚未造成严重损失的；
4） TO cause a fire due to negligence in a ease where serious consequences have not been caused;
第二十七条 违反交通管理，有下列第一项至第六项行为之一的，处十五日以下拘留、二百元以下罚款或者警告；有第七项至第十一项行为之一的，处五十元以下罚款或者警告：
Article27 Any person who commits any one of the following acts, as listed from item 1 to item 6 for violating the Traffic Admini-stration is subject to detention Of not more than fifteen days， a fine of not more than two hundred Yuan or a warning ； any person who commits any one of the following acts ， as listed from item 7 to item 11 is subject to a fine of not more than fifty Yuan or a warning ；
（四）无理拦截车辆或者强行登车，影响车辆正常运行，不听劝阻的；
4） To unreasonably stop or board a vehicle by force and cons-equently interfere with the normal operation of vehicles ， and to refuse to listen to admonition ；
（六）违反交通规则，造成交通事故，尚不够刑事处罚的；
6） To cause a traffic accident in violation traffic regulati-ons ， when not serious enough for criminal punishment ；
（九）饮酒后驾驶机动车辆的；
9） TO drive a motor vehicle after drinking alcoholic beverag-es ；
第三十条 严厉禁止卖淫、嫖宿暗娼以及介绍或者容留卖淫、嫖宿暗娼，违者处十五日以下拘留、警告、责令具结悔过或者依照规定实行劳动教养，可以并处五千元以下罚款；构成犯罪的，依法追究刑事责任。
Article 30 Prostitution, visit to prostitutes, soliciting clients for prostitutes, or sheltering prostitutes and prostitute clients is strictly forbidden. Any offender is subject to detention of not more than fifteen days， or a warning ， or is ordered to make a statement of repentance ， or will be given a punishment of rehabilitation through labor according to regulations ； with a fine of up to five thousand Yuan when necessary ． Those whose acts are deemed criminal ill bear criminal responsibility according to law ．
嫖宿不满十四岁幼女的，依照刑法第一百三十九条的规定，以强奸罪论处。
Sexual relations with a girl under the age of fourteen constitute rape and perpetrators will be punished according to the stipulations in Article 139 of the Criminal Law of the People's Republic of China．
第三十二条 严厉禁止下列行为：
Article 32 The following acts are strictly forbidden：
（二）制作、复制、出售、出租或者传播淫书、淫画、淫秽录像或者其他淫秽物品的。
2） Manufacturing ， replicating ， selling ， renting or distributing pornographic books ， pictures ， video tapes or other materials ．
有上述行为之一的，处十五日以下拘留，可以单处或者并处三千元以下罚款；或者依照规定实行劳动教养；构成犯罪的，依法追究刑事责任。
Violator of this article will be subject to detention Of not more than fifteen days， or a fine of not more than three thousand Yuan as an additional or exclusive punishment ； or be given a punishment of rehabilitation through labor according to regulations; those whose action are deemed criminal will bear criminal responsibility according to law.
备注：外国人财物或证件遗失后应提交以下材料：
NOTE： Aliens who lost his ／ her passport or other property shall submit the following documents ：
l、护照或财物遗失的，需先前往遗失地公安派出所报失；取得报失证明，然后到我处报失，填写遗失经过，经我处调查核实后，发给（护照报失证明）或（财物报失证明）。
If an alien lost his/her passport or property in Hangzhou， he ／ she should first go to the local police station o report the loss ． When he ／ she gets the declaration form of the loss, he/she should come to the Administration Division of Exit and Entry of Hangzhou Municipal Public Security Bureau and report the loss and fill in THE STATEMENT OF THE LOSS. AFTER our investigation, we will issue you CONFIRMATiON OF REPORTING THE LOSS OF PASSPORT or CONF-IRMATION OF REPORTING THE LOSS OF PROPERTY ．
2、在杭州办理的（外国人居留证》或《外国人临时居留证》遗失的，需首先前往遗失地公安派出所报失，取得报案证明。最后凭当地派出所的报案证明到我处报失，经我处调查核实后，可申请补办。
If a alien lost his／ her residence card or temporary residence card issued in Hangzhou ， he ／ she should first go to the local police station to report the loss ， and then declare the loss on the local government newspaper （ for example on Hangzhou DAILY ） . Holding the declaration form of the loss from the local police station he/she may come to our office to report the loss. After our investigation, we will issue him/her a new one.
